Prepares POS and serves all parties (e.g., via TrueFiling, electronic mail, and regular mail). Monitors the Team’s appellate website for all correspondences, includes downloading and cataloging all appellate filings and monitoring deadlines by organizing and maintaining a detailed spreadsheet. If necessary, drafts simple motions (e.g., Motions to Augment and Extensions of Time).

• Opens and appropriately distributes all mail.

Typical Tasks For Senior Paralegal:

- Drafts and prepares a variety of legal documents, correspondence, and reports that are complex and require a great amount of original writing;

- May have responsibility for a highly specialized and complex assignments requiring a high level of independence including the organization of documents used in civil litigation or in the prosecution or defense of major crimes;

- Negotiates and resolves administrative issues with representatives of opposing counsel or client;

- May represent the County or be called upon to provide information at administrative hearings;

Employment Standards

Possession of one of the following:

(1) A paralegal certificate from an American Bar Association (ABA) approved paralegal program;

(2) A paralegal certificate or a degree from a nationally or regionally accredited, or Bureau for Private Post-secondary and Vocational Education-approved post-secondary institution that requires successful completion of a minimum of 24 semester (or equivalent) units in law related courses;

(3) A baccalaureate degree or advanced degree in any subject; plus a minimum of one year of law related attorney supervised* experience; and a written declaration from that attorney* stating that the person is qualified to perform paralegal tasks;

(4) A high school diploma or GED, plus a minimum of three years of law-related attorney supervised* experience; and a written declaration from that attorney* stating that the person is qualified to perform paralegal tasks. This experience and training shall be completed no later than December 31, 2003.

*The supervising and declaring attorney must be an active member of the California Bar for at least the preceding three (3) years, or have practiced in the federal courts of California for at least the preceding three (3) years.

Special Requirement

MCLE Post Employment Standards – Paralegals/Senior Paralegals are required to certify completion of Mandatory Continuing Legal Education (MCLE) credits every two (2) years. These credits consist of four (4) hours of general law or a specialized area of law, and four (4) hours of legal ethics.

Experience Note: In addition to the above, the required knowledge and abilities to perform this function are typically attained through one (1) year of experience as a paralegal.

General Responsibilities: Under the direction of the Director of Domestic Violence Services, the Legal Services Advocate will oversee the TRO (Temporary Restraining Order) Clinic. The Legal Services Advocate will train and assist volunteers with interviewing clients and completing TRO applications. The Legal Services Advocate will train both staff and volunteer advocates. The Legal Services Advocate will also assist with Tri-Valley Haven special events. 

General Requirements: Bachelor’s degree, or equivalent experience. Working knowledge of legal procedures and TRO standards. Two years' experience working with survivors of domestic violence. Ability to work independently, manage time and tasks effectively. Completion of Agency Training within 6 months of employment (if not before). 

SPECIFIC AREAS OF RESPONSIBILITY

I. RESPONSIBLE FOR CLIENT SERVICES AT TVH TEMPORARY RESTRAINING ORDER CLINICS

A. Oversee the work of the Legal Clinic and its volunteers.

B. Train Legal Clinic volunteers.

C. Work with volunteers and staff interviewing clients and completing TRO applications.

D. File and pick up court documents.

E. Attend court hearings when possible.

F. Process special court orders as appropriate.

G. Act as liaison between TVH and volunteer attorneys.

H. Ensure that client materials are completed in an accurate and timely manner.

I. Responsible for attaining grant objectives in each specified area.

J. Compile accurate statistics and other agency documentation for funding sources and internal use; turned in data by the 5th of every month.

K. Handle cases efficiently.

L. Maintain knowledge of changes in laws that directly affect the clients we serve.

M. Comply with all legal and ethical mandates regarding client welfare.

N. Network and consult with other professionals on behalf of clients.

II. GENERAL TASKS - Perform general tasks and represent Tri-Valley Haven in a professional manner.

A. Comply with laws, including elder abuse reporting, CPS reporting, 5150 laws and suicide assessment.

B. Assist with 24-hour domestic violence crisis hotline and client advocacy.

C. Provide resources to residents at Tri-Valley Haven’s DV shelter.

D. Attend agency staff meetings and additional meetings as needed.

E. Participate in community outreach as needed.

F. Participate in community fundraising activities and special events as required.

G. Must have a valid California driver license and an insured automobile to use as necessary for agency related business.

H. Maintain a good Motor Vehicle Record (MVR) to be able to drive for the agency.
